Wynn Resorts Files Lawsuit on Genting over Resorts World Las Vegas
Wynn Resorts Ltd. has filed a lawsuit against Genting Group for its $4.1 billion integrated casino-resort in Las Vegas. The Wynn lawsuit claims Resorts World Las Vegas looks too similar to Wynn’s own up-scale casino properties.
The court filing claims that Resorts World Las Vegas’ exterior is “substantially and confusingly similar” to the Wynn Las Vegas and Encore, which sit across the street from Genting’s resort.
The trademark infringement lawsuit states that Genting’s casino has “a concave facade and horizontal banding above and between the lines of glass panes”, according to the Jakarta Post. Wynn’s lawyers contend the facade looks much like Wynn Las Vegas and Encore.
Genting Group’s Immense Resources
When Resorts World Las Vegas opens in 2019, it will be the most expensive casino-resort ever built in Las Vegas. Genting Group is a multinational conglomerate which owns rubber plantations in Southeast Asia, oil platforms in the Indian Ocean, and a network of hotels and casinos around the globe.
Genting has the resources to produce a first-class integrated casino resort on the Las Vegas Strip. One Genting executive told Nevada officials they wanted to build a “landmark” which tourists would drive to see, regardless of whether they gamble while in town or not.
Wynn Resorts’ Marketing Strategy
Wynn Resorts is known for its luxury resorts, which are located in Las Vegas, Macau, and (soon to be) Boston. Wynn’s founder and former CEO, Steve Wynn, once underscored his company’s strategy of attracting high rollers by saying, “Nobody wants to be around poor people.“
While it is crude way to state a corporate strategy, the 2016 statement gives insight of the thinking behind Wynn Resorts these past 15 years. Wynn builds luxury resorts for high rollers who want to be treated like royalty.
Having a competitor across the street with the resources of a conglomerate and experience running high-end resorts like Resorts World Sentosa is a threat.
Resorts World Las Vegas Aesthetics
Whether Resorts World Las Vegas looks “substantially and confusingly similar” to Wynn Las Vegas is another matter. Genting designed the resort to look like a picturesque Chinese village. The buildings are a bright red, while Wynn Resorts and Encore have a sleak black exterior.
The main hotel tower at Resorts World Las Vegas is shaped similarly to the Wynn Las Vegas and Encore buildings. Whether that is enough when the rest of Genting’s complex is full of red pagodas and a large pavilion are another matter. A drive-by would not immediately suggest they are the same business, but the convex nature of the buildings no doubt have similarities.
Paul Steelman Casino-Resort
Resorts World Las Vegas was designed by Paul Steelman, the legendary resort designer behind Steve Wynn’s Mirage, the Sands Macau, Four Seasons Macau, Galaxy Macau, the Stratosphere, Beau Rivage, the Showboat Atlantic City, Solaire Resort & Casino Philippines, Star Gold Coast in Australia, and Foxwoods Resort.
Whether the design intentionally mimicked Wynn Las Vegas or it is the result of a famed architect’s own creative whims is another matter. If the lawsuit goes to court, one might expect Paul Steelman and Steelman Partners executives to testify about the design process.
